A class action lawsuit has been filed against a popular seafood restaurant in downtown Charleston, after employees allege their tips were kept from them unfairly. Former employees of Eli Hyman, and other owners of Hyman’s Seafood, are suing for minimum wages and overtime compensation. They allege the restaurant’s policy violates the Fair Labor Standards act. Under what’s known as the tip credit, server’s can be paid less than $7.25 as long as their tips get them to or about the minimum ...

FLORENCE — A circuit court judge denied bond Wednesday for a Darlington man a charged in connection with the shooting death of a Lake City man two months ago and set bond for two other Darlington men believed to be accessories to the crime.

Justin Rashawn Simms, 18, of 514 Copeland Drive, was arrested Jan. 20 and charged with murder in the slaying of Marcus Antonio Weaver. He is believed to be the trigger man and was denied bond by Judge Thomas Russo.

Surety bonds in the amount of $60,000 were set for Curtis Joe Jr., 21, of 625 Jamestown Ave., and Joshua Lavern Carraway, 23. Joe was arrested Jan. 30 and charged with accessory before and after the fact of murder in the case, while Carrway was arrested Jan. 14 and charged with attempted armed robbery and accessory after the fact of murder.

Joe and Carraway were scheduled to have hearings before 12th Circuit Court Judge Michael Nettles on Friday, but Nettles recused himself from the matter because as an attorney he’d represented Weaver.

The shooting happened about 11:30 p.m. Jan. 10 in the parking lot of Days Inn at 2111 W. Lucas St., located at Interstate 95 and U.S. 52.

Weaver, 24, of 1180 Beulah Road, Lake City, died and Carraway was wounded.

Investigators allege Simms, Carraway and Joe went to the Days Inn Motel parking lot intending to rob Weaver.

Florence County Sheriff’s investigators Russell Cox and Thomas McFadden, who are handling the case, indicated on the record in court Wednesday that Joe and Carraway have assisted investigators substantially and continue to cooperate.

“They have given statements that law enforcement has been able to verify,” said 12th Circuit Solicitor Ed Clements III said, who is prosecuting the case.
