MOUNT PLEASANT, SC -

Mount Pleasant Council member John Burn is out of jail after he was arrested for driving under the influence this weekend.

Tuesday, Police released dash cam footage of the arrest. In it Burn appears to stumble during a field sobriety test and fails to say a portion of the alphabet before the officer puts him in handcuffs.

It was that DUI charge that brought to light an allegation of Burn's past.

The councilman was accused of sexual assault in 2008 for an incident which allegedly happened in 2003. According to the victim's attorney, Gregg Meyers, Burn and Thomas Calcote "date raped" a woman.

According to the court documents, it was the day after Christmas 2003 that Burn allegedly gave a woman a drink which she claims forced her unconscious.

Meyers said the woman has very little memory of the night but suffered physical and emotional injury.

"A woman who was not completely able to recall the night before," Meyers said. "The allegations were denied but we were also able to get a resolution pretty quickly."

The two men settled out of court and the case was dismissed one year before Burn was elected to council.

In the documents, there is also a plea to have the case closed to the public, which was denied and is therefore surfacing with the new DUI charge.

Burn is due back in court for the DUI charge on April 3rd.
